DONATIONS (GIFTS) VS. SPONSORSHIPS: Everything About New Tax Conditions and Reliefs
Legal Basis, Tax Treatment, Eligible Recipients, and Corporate Income Tax Base Reduction
In business practice, the terms donations and sponsorships are often confused; however, their legal nature and tax treatment are fundamentally different.
Legal and Accounting Definitions
Donation (Gift)
- Legal Basis: In the Croatian legal system, the concept of a donation is most closely regulated as a Gift Contract pursuant to Article 479 of the Civil Obligations Act (Zakon o obveznim odnosima). The contract is formed when the donor undertakes to grant the recipient money, goods, or property rights without any counter-performance (protučinidba), and the recipient accepts it.
- Key Characteristic: A unrequited grant in money, in-kind goods, or services. The recipient provides no advertising or promotion in return.
Sponsorship
- Legal Basis: Sponsorship is a bilateral business relationship in which the sponsor provides monetary or other resources (goods or services) to support events, institutions, associations, companies, projects, or public figures (athletes, artists).
- Key Characteristic: A contractual consideration exists. In return, the sponsor acquires advertising/promotional rights (display of logos on jerseys, billboards, websites, printed materials, etc.).
Eligible Recipients and Tax Treatment
DONATIONS (Article 7, Paragraph 7 of the Corporate Income Tax Act)
For the donor, a donation represents an expense that qualifies as a tax-deductible expense under the following conditions:
- Purpose of Granting: Granted domestically, in cash or in-kind, for cultural, scientific, educational, healthcare, humanitarian, sports, religious, environmental, and other general-benefit purposes.
- Eligible Recipients: Associations and other entities (institutions, foundations, legal entities, public institutions) performing the aforementioned general-benefit activities in accordance with specific regulations.
- Tax Deduction Limits:
- Standard Limit (up to 2% of revenue): Tax-deductible expense up to 2% of total revenue generated in the preceding financial year (or the current year for newly established companies).
- Increased Limit (above 2%) up to a maximum of 10% of revenue: The deductible amount may exceed 2% of revenue if granted pursuant to decisions issued by competent ministries regarding the implementation of funding for special programs and campaigns (e.g., in sports up to 10% of revenue, subject to prior confirmation from the Ministry of Tourism and Sport). Pursuant to Article 7, Paragraph 8 of the Corporate Income Tax Act, the Minister of Tourism and Sport issued the Decision on Projects, Activities, and Eligible Recipients of Donations (Gifts) for Sports Purposes in 2026.
SPONSORSHIPS (Standard Expense vs. Additional Tax Base Reduction)
Under the Corporate Income Tax Act (Zakon o porezu na dobit), sponsorship is fully recognized as a promotion and advertising expense in the year it occurs and is completely independent of the limits applicable to donations.
In addition to standard deductible advertising expenses, Article 6, Paragraph 1, Item 6 of the Corporate Income Tax Act allows for an ADDITIONAL REDUCTION OF THE CORPORATE INCOME TAX BASE for sponsorships granted domestically for cultural, scientific, educational, healthcare, humanitarian, sports, religious, environmental, and other general-benefit purposes.
Eligible Recipients of Sponsorship for Additional Tax Base Reduction (Art. 6, Para. 1, Item 6):
Tax base reduction is recognized if sponsorship is provided to:
- Associations
- Foundations
- Public/Private Institutions (Ustanove)
- Independent Artists
- Legal and natural persons operating within the sports system (sports joint-stock companies, clubs, top-tier athletes acting as self-employed individuals)
- State administration bodies
- Local and regional self-government units (JLP(R)S)
- Other entities performing the specified activities pursuant to special regulations, PROVIDED they execute programs and activities of interest to the Republic of Croatia.
The minister responsible for the activities under Article 6, Paragraph 1, Item 6, with the prior approval of the Minister of Finance, determines by official decision the entities eligible for tax base reduction based on those activities.

Sector-Specific Application Summary (Sports vs. Other Fields)
- IN SPORTS: There is complete statutory automation and legal certainty. The Ministry of Tourism and Sport has published official Decisions designating entities in the sports system that meet the requirements for tax base reduction (governing sports federations, clubs, top-tier athletes operating as self-employed individuals, and local units for facility renovation). The sponsor directly reduces the tax base under Article 6, Paragraph 1, Item 6.
If there is uncertainty regarding recipient eligibility, the sponsor may request an official opinion from the Ministry of Tourism and Sport by contacting sport@mints.hr (Item IV of the Decision dated Feb 23, 2026).
- IN CULTURE, SCIENCE, HEALTHCARE, AND OTHER SECTORS: Article 6, Paragraph 1, Item 6 explicitly references these purposes, as well as independent artists, foundations, and institutions. However, because line ministries (e.g., the Ministry of Culture) have not published consolidated official lists like the sports ministry, it is recommended when entering into sponsorship contracts to gather documentation proving that the project is a “program/project of interest to the Republic of Croatia” or to request a prior binding opinion from the competent ministry / Tax Authority.
